Within CO+I, the Global Supply Chain team is responsible for establishing a supply chain that can meet the ever-growing growth of the Cloud and our customers. We support a portfolio of complex, multi-disciplinary, multi-billion, multi-year datacenter construction and lease projects. Furthermore, we support the Operations team that manages and runs the cloud assets. We are looking to fill a critical role of Construction Contracts Administrator on our Supply Chain Execution team to lead a program of build projects in Atlanta, Georgia; Boydton, Virgina; Bristow, Virginia; Cheyenne, Wyoming; Chicago, Illinois; Des Moines, Iowa; Phoenix, Arizona; San Antonio, Texas; and Wenatchee, Washington.

As a Construction Contracts Administrator, you will play a critical role in ensuring the successful execution of contracts related to construction projects. You will collaborate with cross-functional teams, internal and external stakeholders to manage contractual agreements, mitigate risks, and drive compliance at the Construction job site. Your attention to detail, your commercial, contractual and negotiation skills, and ability to navigate complex contractual landscapes will be essential for this role.

Responsibilities

Documentation Management and Reporting:

  • Prepare regular status reports on issues, risks and mitigations for internal stakeholders.

  • Prepare contractual notices and register the logs as appropriate using language from terms & conditions.

  • Manage the change orders as per contractual terms and conditions.

  • Claims management as required per contractual terms and conditions.

  • Participate in daily, weekly construction meetings at site along with owner stakeholder to provide commercial feedback when required.

  • Ensure SOX (Sarbanes-Oxley Act) and Microsoft Compliance for document filing and document repository.

Project Procurement:

  • Participate in sourcing activities for General Contractors, Architect Engineers, Commissioning Agents, Cost Management, Project Management, and other various professional services as required.

  • Execute sourcing plans to ensure delivery of approved contract strategies and project objectives, on time and within budget as per executed contracts.

  • Assisting in developing suitable negotiation strategies for scope creep, change orders and claims throughout the lifecycle of the contracts.

  • Contribute to supplier evaluation and prepare contract award proposals on an as needed basis.

Contract Review and Compliance:

  • Understanding of the contract terms and conditions while ensuring compliance from relevant parties.

  • Executes procurement contracting strategies for data center construction projects and/or purchasing opportunities to achieve optimal cost and continuity of supply and services.

  • Execute project closeout requirements including claims settlement and demonstrating a complete understanding of lien waivers.

Change Order Management:

  • Assist in Change Order negotiations with input from key stakeholders.

  • Monitor and mitigate the impact of change orders to the project, and partners cross-functionally to resolve/escalate accordingly.

  • Attend change management meetings and report on open change orders as applicable.

  • Assist as the commercial Subject Matter Expert and advise on all change orders based on contractual terms and conditions.

OFCI (Owner Furnished Contractor Installed) Management & Quality Assurance:

  • Help facilitate equipment once delivered to site, including inspections and appropriate sign offs as per contractual obligation.

  • Address quality-related issues as they arise and report as appropriate and work with Project Procurement Managers.

  • Partner with Labor Planning team on Field Service Representative (FSR) constraints during Cx (Commissioning). Ensure GC (General Contractors) schedules are coordinated with Vendor Labor constraints.

Coordination & Communication:

  • Assumes all post-award contract administration responsibilities with General Contract, OFCI (Owner furnished contractor installed) Suppliers, Architect Engineers, Cx(Commissioning), etc.

  • Facilitate and own commercial decision making on all post-award activities through collaborating and influencing project stakeholders.

Risk Management:

  • Identify potential challenges related to the project/contract and develop risk mitigation strategies to maintain compliance.

  • Participate in risk review meetings and provide inputs on the project/contractual risks.

Payment Processing:

  • Address and resolve any payment disputes submitted by General Contractors/Suppliers.

  • Ensure that all liens are submitted and contracts are closed out properly for final close out.

Negotiation:

  • Help facilitate and engage as needed in negotiations with contractors and other parties to resolve disputes.

  • Help in creating negotiating strategies.

Subcontractor Procurement:

  • Monitor the GC’s subcontracting procurement as required and mitigate any foreseen risks.

  • Collaborate cross-functionally with stakeholders to review and the GC’s subcontractor procurement deliverables and final recommendation of subcontractor award package.

Stakeholder Collaboration:

  • Drives commercial compliance and problem resolution with General Contractors, Subcontractors and Suppliers.

  • Actively partners with suppliers to identify and drive continuous improvement and risk management opportunities by evaluating procedural, operational, and/or environmental factors, analyzing root causes of issues, sharing insights with key stakeholders, and influencing the adoption of needed improvements.

  • Drives business engagement and partnership with cross-functional teams including Planning, Strategic Sourcing, Cost Management, Engineering, Quality, Construction and Project Managers.

Compliance: * *

  • Ensures consistency, timeliness, quality, and accuracy of deliverables, and ensures Procurement stakeholders are aware of Service Level Agreement (SLA) and/or defined milestones and deliverables terms. Communicates delay to Procurement stakeholders, and independently proposes and executes contingency measures. 

  • Ensures adherence to policy, educates stakeholders and suppliers on policy compliance, and manages the remediation and resolution of sourcing issues. Identifies opportunities to adapt policy as needed to mitigate risk and better enable suppliers to meet business requirements.

Qualifications

Required/Minimum Qualifications

  • Bachelor's Degree in Engineering, Computer Science, Supply Chain, Data Analytics, Business, Finance or related field AND 5+ years experience (including internships) in Data Science/Analytics, Finance, Project Management, Supply Chain, and/or Operations

  • OR Master's Degree in Engineering, Computer Science, Supply Chain, Data Analytics, Business, Finance or related field AND 4+ years experience in Data Science/Analytics, Finance, Project Management, Supply Chain, and/or Operations

  • OR equivalent experience.

  • Hyperscale data center OR large building construction experience in an owner or general contractor capacity.

  • Experience developing and negotiating contract terms and conditions specifically for contracts related to services, construction, engineering, materials and equipment installation.

  • Experience in handling various contract types (for exampleGuaranteedMaximum Price, Lumpsum, Unit Rate, Hybrid and others).

Other Requirements

Ability to meet Microsoft, customer and/or government security screening requirements are required for this role. These requirements include but are not limited to the following specialized security screenings: Microsoft Cloud Background Check: This position will be required to pass the Microsoft Cloud Background Check every two years thereafter. 

Preferred Requirements

  • Bachelor's Degree in Engineering, Computer Science, Supply Chain, Data Analytics, Business, Finance or related field AND 6+ years experience in Data Science/Analytics, Finance, Project Management, Supply Chain, and/or Operations

  • OR Master's Degree in Engineering, Computer Science, Supply Chain, Data Analytics, Business, Finance or related field AND 5+ years experience in Data Science/Analytics, Finance, Project Management, Supply Chain, and/or Operations

  • OR equivalent experience

  • Demonstrated understanding of contracting principles and legal terms and conditionsof construction contracts

  • Broad understanding of the construction industry and contract language associated engineering, procurement, fabrication, and construction/construction management (including Engineering, Procurement and Construction / Construction Management)

  • Demonstrated negotiation, communication, and interpersonal skills.

  • Detail-oriented with the ability to manage multiple contracts simultaneously.

  • Experienced in Claims Management and construction contracts closeout.

  • Proficiency in contract management software and tools.

Sourcing and Category Management IC4 - The typical base pay range for this role across the U.S. is USD $91,800 - $178,800 per year. There is a different range applicable to specific work locations, within the San Francisco Bay area and New York City metropolitan area, and the base pay range for this role in those locations is USD $117,900 - $195,000 per year.
